A good day for the NRA compliment of the Supreme Court.
Posted 22 weeks 6 days ago byAfter a hiatus of 69 years, the Supreme Court has ruled today on the meaning of the 2nd Amendment in the highly anticipated case of District of Columbia v. Heller. Not since 1939 has the Supreme Court heard a case testing the 2nd Amendment scope.
This is the ultimate question here: Does the 2nd Amendment guarantee an individual right to have a gun for private use, or does it only guarantee a collective right to have guns in an organized military force such as a state National Guard unit?
This is the text of the 2nd Amendment: "A well regulated Militia, being necessary to the security of a free state, the right of The People to keep and bear Arms, shall not be infringed."
The term individual doesn't appear in the 2nd Amendment . However, the conservatives Justices prevailed today in the ruling, the Supreme Court decided ( 5 to 4) that the Washington DC hand guns ban and the trigger-lock requirement violate the " individual right " to bear Arms protected under the 2nd Amendment.
This is a decision that will please the " gun loving " folks of the Right and the NRA......and will very likely cause more Americans to be killed.
Needless to say , President Bush will be very pleased by the ruling. The Major of Chicago has already voiced his vehement opposition to the Supreme Court's ruling of today and he will not be the only one.

Submitted on June 27th, 2008 by PabloThe truth about gun laws is that that more often they are targeting responsible citizens rather than those who are not responsible and often are criminal.
In every state of the Union and by almost every major univeristy in the nation has done studies about crime and gun control!
What all those studies have found is that where the citizens are well armed there is virtually no crime to speak of. What crime there is happens to be minor.
Here in Texas a little community down by Victoria allowed its citizens to do open carry which is not legal here in Texas. The city and sheriff decided that more crime could be prevented especially violent crime. The little community had out of control crime where homes were being robbed, rapes were out of hand from a few a year to a few a week! After the open carry was allowed, crime came to a halt!
Robbery dropped 99%! Rapes went from 4 a week to 2 a year! There has not be a murder in that community in 18 years since the open carry was allowed!
The truth is that people kill more criminals out of self defense protecting themselves against a crime in progress than the police by more than 60,000 a year!
The FBI and several other related fields have reported their findings about guns and gun control which you can read in the Journal of Criminal Law and Criminology.
The FBI although says that criminals should never be allowed to own guns or purchase guns, that where communities which are often more rual and have a gun tradition have significantly less crime that places which have strict gun control!
The problem is that gun control beyond criminals to regulate crime only gives more power to the criminals to over power the people and do more crime!
As a black gun rights person named Thomas Sowell states that citizens are being disarmed by the government much the same way slaves were disarmed! If the slaves has access to guns, there would have been no slavery.
But the main point is that where private law abiding citizens are well armed the crime rate is exceedingly low.
If places like Washington DC, Chicago, Philidelphia and LA would promote to the law abiding citizens to arm themselves against the criminals then you would see better than 80% drop in crime in those cities.
Crime is only out of control because the criminals have nothing to fear! After all, they are armed and the most common citizens are not!
My neighbor shot a man crawling through his 7 year old son's window last year. The guy was a known meth user and was on the sex registry as a pedophile. So I tell everyone who is law abiding! Arm yourselves. Do not expect the police to be on the scence when the crime happens. Police 99% of the time only show up after the event happened. Its just rare for them to make it while the crime is in progress. Be responsible gun owners. Have gun locks and a bolted down heavy metal gun cabinate! Get yourself a concealed gun permit and go to the shooting range at least 4 times a year! Know your guns inside and out. Be able to use your gun at night! Which means requesting that your range offer realistic night shooting conditions at certain times so that you will not be scared of and know what you are doing in the dark.
This is common sense to those of us who have been around weapons all our lives. I have a permit to carry but never have had to draw my weapon. But there have been times, I was more than glad I had the gun. Simply, the act of reaching is enought to make a criminal think twice and run away!!

What the meaning of "people" is
Submitted on June 27th, 2008 by rom12921The dissenting opinion excerpts indicate an interpretation toward collective "keeping" of firearms as part of a militia.
Dissenters interpret "people" in "...the right of The People.." to mean people in an organized force like police or military.
The majority maintains "people" has the same definition as "we the people" - individual. I think in using the term consistently, the ruling is correct.
Seems illogical to pass laws and to expect the lawless to comply.

Granted one can argue that bigger historic issues/agendas were at play in some of them, but even then state abuses of unarmed 'civilian' sectors would certainly have been difficult if not impossible to fully carry out. It is critical that the state must always be wary of some actual physical prowess of those it might choose to walk willy-nilly over. It does not take any state long to modify its behavior especially under trying circumstances. Under the constitution, it is the duty of the expressed duty of state to support the right. Their government, through this legislation, spent $500 million dollars in Australia taxpayer money, to destroy these guns. Their crime statistics, year after removing private ownership of guns is as follows. Australia-wide, homicides are up 3.2 percent. Australia-wide, assaults are up 8.6 percent. Australia-wide, armed robberies are up 44 percent. In the state of Victoria alone, homicides with firearms are now up 300 percent. Note that while the law-abiding citizens turned their guns in, the criminals did not, and the criminals still possessed their guns to commit crime. While figures over the previous 25 years showed a steady decrease in armed robbery with firearms, this has changed drastically upward in the past
12 months, since criminals now are guaranteed that their prey is unarmed.
There has also been a dramatic increase in break-ins and assaults of the ELDERLY. Australian politicians are at a loss to explain how public safety has decreased, after such monumental effort and expense was expended in successfully ridding Australian society of guns."

Comparing the type of small towns you bring up in your comment to big urban areas such as DC, Chicago, LA or New-York is not a valid argument.
The Major of Chicago has expressed promply his disagreement with the Supreme Court ruling. The murder rate in DC was down because of the ban....and now it will go up, thanks to the ruling.

"The New American magazine reminds us that March 25th marked the 16th anniversary of Kennesaw, Georgia's ordinance requiring heads of households (with certain exceptions) to keep at least one firearm in their homes. The city's population grew from around 5,000 in 1980 to 13,000 by 1996 (latest available estimate). Yet there have been only three murders: two with knives (1984 and 1987) and one with a firearm (1997). After the law went into effect in 1982, crime against persons plummeted 74 percent compared to 1981, and fell another 45 percent in 1983 compared to 1982. And it has stayed impressively low. In addition to nearly non-existent homicide (murders have averaged a mere 0.19 per year), the annual number of armed robberies, residential burglaries, commercial burglaries, and rapes have averaged, respectively, 1.69, 31.63, 19.75, and 2.00 through 1998. By comparison, the population of Morton Grove, the first city in Illinois to adopt a gun ban for anyone other than police officers, has actually dropped slightly and stands at 22,202, according to 2005 statistics. More significantly, perhaps, the city's crime rate increased by 15.7 percent immediately after the gun ban, even though the overall crime rate in Cook County rose only 3 percent. Today, by comparison, the township's crime rate stands at 2,268 per 100,000. This was not what some predicted.

After all, its becoming clear that police are no longer able to protect the law abiding citizens from the criminal trash of society!
People will have to protect themselves.
Like the 14 year old girl home alone who was targeted by three Illegal aliens where she shot and killed 2 with her shotgun and wounded the third. The Aliens were there for rape and robbery!
